Purpose: This section describes the general eligibility requirements for assistance for a person who is unable to work due to incapacity.

WAC 388-400-0025 Who is eligible for general assistance unemployable?

  1. You can get general assistance - unemployable (GAU), benefits if you:

    1. Are incapacitated as required under WAC 388-448-0010 through 388-448-0120;

    2. Are at least eighteen years old or, if under eighteen, a member of a married couple;

    3. Are in financial need according to GAU income and resource rules in chapters 388-450, 388-470 and 388-488 WAC;

    4. Meet the general assistance citizenship / alien status requirements under WAC 388-424-0015(2);

    5. Provide a Social Security number as required under WAC 388-476-0005;

    6. Reside in the state of Washington as required under WAC 388-468-0005;

    7. Undergo a treatment and referral assessment as provided under WAC 388-448-0130 through 388-448-0150;

    8. Assign interim assistance as provided under WAC 388-448-0210;

    9. Report changes of circumstances as required under WAC 388-418-0005; and

    10. Complete a mid-certification review and provide proof of any changes as required under WAC 388-418-0011.

  2. You cannot get GAU benefits if:

    1. You are eligible for temporary assistance for needy families (TANF) benefits:

    2. You are eligible for state family assistance (SFA) benefits unless you are not eligible under WAC 388-400-0010;

    3. You have the ability to, but refuse to meet a TANF or SFA eligibility rule;

    4. You are eligible for Supplemental Security Income (SSI) benefits;

    5. You are an ineligible spouse of an SSI recipient; or

    6. Social Security Administration (SSA) denied your application for benefits or terminated your benefits for failing to follow a SSI program rule or application requirement.

  3. We determine who is in your assistance unit according to WAC 388-408-0010.

  4. A "public institution" is an institution that is supported by public funds, and a governmental unit either is responsible for it or exercises administrative control over it. If you live in a public institution, you may be eligible for GAU depending on the type of institution you are in.

    1. If you reside in a public institution and are otherwise eligible for GAU, you may be eligible for general assistance if you are:

      1. A patient in a public medical institution; or

      2. A patient in a public mental institution and are:

        1. Sixty-five years of age or older; or

        2. Twenty years of age or younger.

    2. You are not eligible for GAU when you are in the custody of or confined in a public institution such as a state penitentiary or county jail including placement;

      1. In a work release program; or

      2. Outside of the institution including home detention.

CLARIFYING INFORMATION

 

  1.  Persons who are currently ineligible for TANF due to the non-compliance sanction in WAC 388-310-1600 are not eligible for General Assistance per WAC 388-400-0025(2)(c). 

  2. PRUCOL aliens do not need to provide a Social Security Number, per WAC 388-424-0009(2).  Therefore, the Social Security requirement in WAC 388-400-0025(1)(e) does not apply.
