Chemical Dependency Treatment - Exception to Rule and Fair Hearings

Purpose: To describe ADATSA relationship to ETR and Fair Hearings.

ADATSA Exception to Rule (ETR)

  1. The assessment agency can initiate a request for an Exception to Rule to authorize ADATSA for clients not meeting the incapacity eligibility criteria. The CSO will formalize the request and submit it through the ETR process. (See EXCEPTION TO RULE).

  2. The request may be initiated by the assessment agency by providing the CSO with all the information the department will need to consider the request.

Fair hearings

  1. An ADATSA treatment client requesting a fair hearing is not eligible for continued assistance pending a fair hearing per WAC 388-800-0090(5).

  2. A shelter recipient requesting a fair hearing within the advance notice period before termination from independent housing is eligible for continued assistance, paid through a protective payee, pending the fair hearing. See FAIR HEARINGS.
