Fair Hearing

Purpose:

ACES automatically prints the fair hearing rights on all letters mailed from State Office or issued to a client in the local CSO.

When a client requests a fair hearing and benefits are to be continued pending the outcome of the hearing, reinstate the AU that has been closed, or reopen the AU that has been denied.

When reopening a case due to a fair hearing request, check to be sure that the letter ACES generates is the appropriate letter.

In some situations, while the fair hearing is pending it is necessary to issue benefits to the same individual for the same month in two different AUs.

To do this in ACES:

  1. Let benefits issue for the person in the first AU.

  2. Then close the client in the first AU.

  3. Open the client in the second AU by entering the appropriate code in the CONCURRENT RECEIPT field on the (DEM1) in the current month to avoid dual participation edits when finalizing the newAU.

  4. This procedure must be done each month as long as assistance has to be continued pending the hearing.

In some situations reopening or reinstating a case will not work because, based on the case situation, the client is not eligible, so the AU will not stay open.


NOTE: The Appeal indicator on the (STAT) does not affect processing.

EXAMPLE

Refugee client in the country more than 8 months has requested a fair hearing. If the client's actual entry date is used the client will be denied.


NOTE: There is a change pending to allow users to process this type of case. Until this change is made users must call ITD Customer Support (360-664-4560) for assistance in processing their cases.
